Delivery & Warranty

General
Delivery will be via Courier or be Australia Post

All costs of delivery, including freight, storage, handling, freight forwarding, customs handling (if any) and insurance will be borne by the Buyer. If Your Security Online arranges delivery of the Products, it does so as agent for and on behalf of the Buyer

Any statement made by Your Security Online in any form (and whether or not in an acceptance of an order) as to delivery date is an estimate given in good faith by Your Security Online but shall in no case, unless otherwise agreed in writing by Your Security Online, be binding on Your Security Online.

Your Security Online will have no liability whatsoever (other than the refund or partial refund of monies paid by the Buyer in respect of such order) for any failure to deliver or procure delivery of the whole or any part of any order of Products which may have been made by the Buyer or for any delay in delivering the same for any reason whatsoever. In particular without limiting the generality of the foregoing, Your Security Online will not be liable for any consequential, economic loss or loss of profit and will not be liable to indemnify the Buyer in respect of any liability the Buyer may have to any customer of the Buyer arising from delayed or non-delivery of the Products.

Your Security Online does not warrant that it will have a supply of any Products sufficient to meet the Buyer's orders and the Buyer will make no demand, claim nor commence any action or proceedings against Your Security Online, should Your Security Online not meet the Buyer's orders or any of them.

Warranty on equipment is as listed on the product description.

Warranty returns are strictly Return to Base (RTB) with equipment being returned being subject to testing before warranty replacement is accepted. Damage to equipment resulting from improper installation, Power Surges or Lightning Strikes are not covered by the manufacturers or Your Security Online.

Your Security Online reserves the right to determine the right of a warranty replacement or part there of based on the state of the equipment returned and the type of damage sustained.

Buyer's Warranty
The Buyer warrants and agrees that:-
a) it is entitled to enter into this agreement;
b) it has taken all necessary internal steps to authorise entering into this agreement;
c) the person who signs this agreement on behalf of the Buyer is authorised to do so; and
d) the Buyer is solvent, able to pay its debts as they fall due and has not entered into (or been threatened with) liquidation, provisional liquidation, receivership, voluntary administration or any other administration in insolvency.

Limit of Liability
As the alarm communicates by using telephone lines, Your Security Online makes no representation nor accepts any liability for the programming and testing nor the suitability of the quality or type of telephone line that the purchaser is fitting the equipment on to. The monitoring of alarm systems over VOIP (Voice over Internet Protocol) is not recommended and should be avoided

Your Security Online makes no representations or warranties of any kind, express or implied, as to the operation of this web site, completeness, accuracy, usefulness, or the information, the content, the data, the services, or the products included on this web site. To the full extent permissible by applicable law, Your Security Online disclaims all warranties and claims, express or implied, included but not limited to, failure of equipment to operate or loses resulting from the failure of equipment supplied, implied warranties of merchantability, fitness for a particular purpose, or non-infringement of intellectual property rights.

Any product, process or technology displayed on this web site may be subject to intellectual property rights of Your Security Online or third parties.

Limitation and Exclusion of Liability
1 Important Notice - nothing in this agreement shall or shall be construed as excluding or limiting the application of any statute which may not be excluded or limited and in particular without limiting the generality of the foregoing, will not exclude or limit the application of any implied term, warranty or remedy conferred or imposed by the Trade Practices Act, 1974 (Commonwealth) or any Fair Trading Act of any state of Australia, which may not be excluded or limited.

2 Your Security Online's liability for a breach of this agreement is limited to any one of the following, at Your Security Online's option, namely:-
a) in the case of a breach with respect to goods:-i) replacement of the goods or the supply of equivalent goods; ii) repair of the goods; iii) payment of the cost of replacing the goods or acquiring equivalent goods; or iv) payment of the cost of having the goods repaired;
b) in the case of a breach with respect to services:- i) resupplying the services; or ii) payment of the cost of having the services resupplied.

3 Subject to clause 1 all terms, warranties and conditions not expressly contained in this agreement are hereby excluded.

4 Subject to clause 1, Your Security Online will not be liable for consequential loss, economic loss, loss of profit, loss of business opportunity or other indirect loss of any kind.

5 Subject to clause 1, Your Security Online will not be liable for any losses attributed to the failure of a device to operate as indicated as Your Security Online.
